Β About these terms

These terms and conditions govern participation in the Xanadu Living Creator Collective (β€œProgram”).

In these terms:

  • β€œCreator” means a person approved to participate in the Program.
  • β€œCreator Code” means a personal promotional or discount code issued to a Creator.
  • β€œCreator Link” means a personal affiliate or tracking link issued to a Creator.
  • β€œContent” includes photographs, videos, Reels, stories, posts, captions, reviews, graphics, written material and AI-assisted creative material.
  • β€œEligible Sale” has the meaning given in clause 6.
  • β€œEligible Net Product Sales” has the meaning given in clause 7.
  • β€œProgram” means the Xanadu Living Creator Collective.
  • β€œXanadu Living”, β€œwe”, β€œus” and β€œour” mean the Program operator identified above.

2. Eligibility

To participate in the Program, a Creator must:

  1. Be at least 18 years old.
  2. Reside in Australia unless Xanadu Living approves otherwise in writing.
  3. Provide accurate application, contact and payment information.
  4. Operate at least one genuine social-media account, website, email audience or other approved content channel.
  5. Comply with these terms and all applicable laws and platform rules.
  6. Receive written approval from Xanadu Living.

There is no minimum follower count.

Application to or participation in the Program does not guarantee approval, sales, income, free products, paid content work or future collaboration opportunities.

Xanadu Living may approve or decline an application at its discretion.

3. Acceptance

The Creator accepts these terms by doing any of the following:

  1. Replying to an approval email with the acceptance statement specified in clause 22.
  2. Accepting the Program through Shopify Collabs or another nominated platform.
  3. Activating or using a Creator Code or Creator Link.
  4. Otherwise commencing participation in the Program after receiving these terms.

A Creator must not begin promoting their Creator Code or Creator Link until they have received approval from Xanadu Living.

4. Independent affiliate relationship

The Creator participates as an independent affiliate and not as an employee, worker, agent, partner, franchisee or legal representative of Xanadu Living.

The Creator:

  1. Is not required to work set hours.
  2. Controls whether, when, where and how frequently they promote Xanadu Living.
  3. Is not required to produce a minimum number of posts unless separately agreed in writing for a specific collaboration.
  4. Is not guaranteed any minimum income, commission or work.
  5. May promote or work with other businesses, subject to these terms.
  6. Provides their own equipment and pays their own operating expenses.
  7. Cannot enter into agreements, incur liabilities or make representations on behalf of Xanadu Living.
  8. Is paid commission for achieving Eligible Sales and not for hours worked.

The Creator is not authorised to describe themselves as an employee, representative, spokesperson or agent of Xanadu Living.

Nothing in these terms excludes or transfers any employment, taxation, superannuation or other obligation that Australian law places directly on either party.

Any separately agreed paid UGC, photography, video production or content service may be subject to an additional written agreement.

5. Creator Codes and Creator Links

Approved Creators may receive a personal Creator Code, Creator Link or both.

The Creator must only use their Creator Code and Creator Link for genuine promotional activity.

The Creator must not:

  1. Allow another person to represent themselves as the approved Creator.
  2. sell, transfer or assign their Creator Code or Creator Link.
  3. Publish their code on coupon, cashback or discount-code websites without written approval.
  4. Purchase through their own Creator Code or Creator Link to generate commission.
  5. Ask another person to make an artificial purchase on their behalf.
  6. Use bots, fake accounts, automated traffic or other artificial methods.
  7. Use cookie stuffing, forced redirects or misleading links.
  8. Send unlawful or unsolicited promotional messages.
  9. Make false or misleading claims to generate sales.
  10. Bid on β€œXanadu Living” or related brand terms through paid search advertising without written approval.
  11. Register domain names, social-media handles or advertising accounts containing the Xanadu Living name or a confusingly similar term.
  12. Impersonate Xanadu Living or create an account that could reasonably appear to be an official Xanadu Living account.

Xanadu Living may change, suspend or deactivate a Creator Code or Creator Link where reasonably necessary to administer the Program, correct an error or address suspected misuse.

6. Eligible Sales

An β€œEligible Sale” is a genuine customer order that:

  1. Is properly attributed to the Creator through Shopify Collabs or another tracking system nominated by Xanadu Living.
  2. Uses the Creator’s approved Creator Code or Creator Link, where required.
  3. Has been paid for by the customer.
  4. Has not been cancelled, refunded, returned or charged back.
  5. Is not fraudulent, artificial or self-referred.
  6. Contains products eligible for commission.
  7. Complies with these terms and any additional campaign conditions.

A sale is not eligible for commission merely because a customer states that they saw a Creator’s content. The transaction must be recorded and attributed through the applicable tracking system.

Technical issues, cookie settings, customer actions, use of another discount code or switching devices may prevent attribution. Xanadu Living is not required to manually attribute a sale unless its records reasonably establish that a clear tracking error occurred.

If more than one creator link or code is associated with an order, attribution will be determined by the applicable tracking platform and Xanadu Living’s reasonable assessment of the transaction.

7. Commission calculation

Subject to these terms, the Creator may earn:

  1. 2% commission from their first confirmed Eligible Sale.
  2. 3% commission on future Eligible Sales after generating $2,500 in cumulative confirmed Eligible Net Product Sales.
  3. 4% commission on future Eligible Sales after generating $10,000 in cumulative confirmed Eligible Net Product Sales.

Tier increases apply only to future Eligible Sales and are not retrospective unless Xanadu Living confirms otherwise in writing.

Commission is calculated on Eligible Net Product Sales.

β€œEligible Net Product Sales” means the product amount actually paid by the customer after discounts and excluding:

  1. GST.
  2. Delivery, freight and shipping charges.
  3. Refunded or returned amounts.
  4. Cancelled or unpaid orders.
  5. Chargebacks.
  6. Fraudulent transactions.
  7. Gift-card purchases.
  8. Products, brands or orders excluded from the Program.

Delivery, freight and shipping charges are not eligible for commission under any circumstances.

Commission is calculated on the eligible product sale amount excluding GST. It is not calculated on:

  1. The total customer order value where that value includes GST or shipping.
  2. The original product price before discounts.
  3. Xanadu Living’s gross or net accounting profit.

Commission example

If a customer pays:

  • $550 including GST for eligible products; and
  • $100 for delivery,

the commissionable amount is $500.

At a 2% commission rate, the Creator would earn $10.

Xanadu Living’s and Shopify Collabs’ transaction records will be used to calculate commission, subject to the correction of any clear technical or accounting error.

8. Commission tiers

Cumulative sales used to determine a Creator’s commission tier are based on confirmed Eligible Net Product Sales.

Pending, cancelled, refunded, returned, fraudulent or ineligible sales do not count towards a commission tier.

If a previously confirmed sale is later refunded, returned or charged back, Xanadu Living may adjust the Creator’s cumulative sales total and commission tier.

Xanadu Living may offer higher rates, bonuses or campaign-specific incentives to selected Creators. Such offers only apply when confirmed in writing and do not create an entitlement for other Creators.

9. Validation and payment

Commission remains pending during the applicable order-validation period so that refunds, returns, cancellations, fraud and chargebacks can be identified.

Approved commission will be paid through Shopify Collabs or another payment method nominated by Xanadu Living.

Payment timing may be affected by:

  1. The Shopify Collabs payment schedule.
  2. Xanadu Living’s customer returns period.
  3. Unresolved cancellations, refunds or chargebacks.
  4. Incomplete or inaccurate payment information.
  5. Suspected fraud or a potential breach of these terms.
  6. Taxation or identity information reasonably required to process the payment.

Xanadu Living may reverse, withhold from future commission or recover commission relating to:

  1. A refunded, returned or cancelled order.
  2. A fraudulent, artificial or self-referred order.
  3. A breach of these terms.
  4. An incorrect payment or calculation.
  5. A tracking or system error.

The Creator must maintain accurate payment details. Xanadu Living is not responsible for delays caused by incorrect, incomplete or outdated information supplied by the Creator.

10. ABN, GST and taxation

A Creator is not required to hold an Australian Business Number (β€œABN”) solely to apply for or participate in the Program.

A Creator who has an ABN may provide it to Xanadu Living as part of their payment information.

Where a Creator does not have an ABN, Xanadu Living may request additional information or a properly completed ATO Statement by a Supplier if reasonably required for taxation, payment, accounting or record-keeping purposes.

Xanadu Living may deduct or withhold an amount from a commission payment where required by Australian taxation law. Xanadu Living will not withhold tax unless reasonably considered necessary to comply with a legal obligation.

The Creator must notify Xanadu Living if they are registered for GST.

Where a Creator is registered for GST, any applicable GST relating to the Creator’s services will be handled in accordance with Australian taxation law. Xanadu Living may require a valid tax invoice or another approved form of documentation before paying an additional GST amount.

Unless otherwise stated, the Program commission percentages are calculated on Eligible Net Product Sales excluding GST.

The Creator is responsible for:

  1. Determining whether commission, discounted products or other Program benefits must be declared.
  2. Declaring Program income where required.
  3. Determining whether they require an ABN.
  4. Determining whether they are required to register for GST.
  5. Maintaining their own taxation and financial records.
  6. Obtaining their own taxation, financial, accounting or legal advice.
  7. Paying any tax, GST, insurance, registration or other liability applying to their activities.

Xanadu Living does not provide Creators with personal taxation, accounting, financial, Centrelink, employment or legal advice.

Nothing in this clause transfers or removes any taxation, superannuation, reporting or withholding obligation that Australian law places directly on Xanadu Living.

11. Advertising disclosure

The Creator must clearly and prominently disclose their commercial relationship with Xanadu Living whenever:

  1. Promoting Xanadu Living or its products.
  2. Sharing a Creator Code or Creator Link.
  3. Publishing content from which they may receive commission.
  4. Featuring a gifted, discounted or creator-cost product.
  5. Receiving any other benefit from Xanadu Living.

Acceptable disclosures include:

  • β€œAd”
  • β€œAdvertisement”
  • β€œAffiliate linkβ€”I may earn commission from purchases.”
  • β€œI earn commission when you purchase using my code.”
  • β€œProduct purchased at a special creator price.”

The disclosure must:

  1. Be easy to notice and understand.
  2. Appear prominently within the content or caption.
  3. Be visible before or at the time the audience engages with the promotion.
  4. Not be hidden among hashtags.
  5. Not be obscured behind a β€œmore” button where it is unlikely to be seen.
  6. Not rely solely on tagging Xanadu Living.
  7. Not use vague wording that fails to explain the commercial relationship.

The Creator must comply with the Australian Consumer Law, the AANA Code of Ethics, applicable platform rules and all other relevant advertising requirements.

12. Content and product claims

All statements about Xanadu Living and its products must be truthful, accurate and based on information supplied or approved by Xanadu Living.

The Creator must not:

  1. Claim to own, use or have personally tested a product unless that is true.
  2. Publish a false or misleading testimonial or review.
  3. Create the impression that an advertisement is an independent customer review.
  4. Make unauthorised claims about product performance, safety, availability, materials, price, delivery or warranties.
  5. Make medical, health, therapeutic or safety claims that have not been approved by Xanadu Living.
  6. Misrepresent the size, scale, colour, features or appearance of a product.
  7. Advertise an expired offer as current.
  8. State that a product is free, gifted or discounted where that is not true.
  9. Publish unlawful, defamatory, offensive or discriminatory content.
  10. Use third-party images, videos, music or other intellectual property without permission.

Xanadu Living may request the correction or removal of inaccurate, misleading, unlawful or non-compliant content.

The Creator must promptly make a reasonable correction or removal requested under this clause.

13. AI-assisted content

Creators may use AI-assisted room concepts and lifestyle imagery as styling inspiration, provided that the content is not false or misleading.

The Creator must not:

  1. Describe an AI-generated room as their actual home.
  2. Claim to possess or have personally used an AI-generated product.
  3. Present AI-generated imagery as an exact representation of product dimensions, colour, materials or scale.
  4. Create a false personal review using AI-generated content.
  5. Make a product appear to have features it does not have.

AI-generated or materially AI-altered content should include a clear statement such as:

β€œConcept image created for styling inspiration. Product appearance, dimensions and scale may vary.”

Xanadu Living may request changes to or removal of AI-assisted content that could reasonably mislead customers.

14. Xanadu Living creative assets

Xanadu Living may provide approved product photographs, descriptions, logos, videos and promotional assets.

These assets remain the property of Xanadu Living or its licensors.

The Creator receives a limited, revocable, non-exclusive and non-transferable licence to use the supplied assets solely to promote Xanadu Living while participating in the Program.

The Creator must not:

  1. Materially alter the Xanadu Living logo.
  2. Remove copyright, trademark or ownership notices.
  3. Resell, sublicense or distribute the assets as standalone files.
  4. Use the assets to promote another business.
  5. Use expired promotional artwork after the applicable campaign has ended.
  6. Create the impression that the Creator owns or officially represents Xanadu Living.

The Creator must stop using supplied assets when requested or when their participation ends, except where an existing social-media post is permitted to remain online.

15. Creator-owned content and usage rights

Unless separately agreed in writing, the Creator retains copyright in original Content they create.

By directly submitting Content to Xanadu Living, tagging Xanadu Living for the purpose of being featured, or expressly inviting Xanadu Living to share the Content, the Creator grants Xanadu Living a non-exclusive, royalty-free licence for 24 months to reproduce and repost that Content through:

  1. Xanadu Living’s organic social-media accounts.
  2. The Xanadu Living website.
  3. Xanadu Living email marketing.
  4. Organic promotional materials relating to the Creator Collective.

Xanadu Living will provide reasonable creator attribution where practical.

The licence in this clause does not automatically include the right to:

  1. Use the Content in paid advertising.
  2. Make substantial edits to the Content.
  3. Sell the Content to a third party.
  4. Sublicense the Content to an unrelated business.
  5. Use the Creator’s image or likeness beyond the permitted 24-month period.

Paid advertising, extensive editing, third-party licensing or extended usage requires separate written permission unless already agreed for a specific campaign.

The Creator confirms that:

  1. They own or have permission to use everything included in their Content.
  2. Their Content does not infringe another person’s intellectual property or privacy rights.
  3. Every identifiable adult appearing in the Content has consented to its publication and permitted use.
  4. The parent or legal guardian of every identifiable child appearing in the Content has consented to its publication and permitted use.

16. Gifted and creator-cost products

Free or gifted products are not automatically included in the Program.

Xanadu Living may, at its discretion, offer selected products to an approved Creator at creator cost or another agreed discounted price in exchange for specific Content.

Any creator-cost or gifted-product collaboration must be approved in writing before the product is ordered or supplied.

The written approval should identify:

  1. The approved product.
  2. The price payable by the Creator.
  3. Applicable delivery or freight charges.
  4. The Content to be produced.
  5. The agreed platform.
  6. The posting or delivery timeframe.
  7. The required advertising disclosure.
  8. The content-usage rights granted to Xanadu Living.
  9. Any additional campaign conditions.

Unless expressly agreed otherwise:

  1. The Creator is responsible for the approved product price.
  2. The Creator is responsible for applicable delivery and freight charges.
  3. A creator-cost purchase does not guarantee commission or sales.
  4. Commission is only earned from separate Eligible Sales attributed to the Creator.
  5. The Creator must disclose that they received a discounted or creator-cost product.
  6. The Creator must not describe a creator-cost product as gifted or free.

Any return restrictions will be subject to rights and remedies that cannot legally be excluded under the Australian Consumer Law.

17. Brand safety and conduct

The Creator must not associate Xanadu Living with:

  1. Unlawful activity.
  2. Hateful, discriminatory or harassing content.
  3. Sexually explicit material.
  4. Serious violence or threats.
  5. Fraudulent or deceptive conduct.
  6. Content that could reasonably cause significant reputational harm.
  7. Promotion of counterfeit or unlawfully obtained products.

The Creator must communicate professionally with customers, other Creators and Xanadu Living representatives.

Xanadu Living may immediately suspend participation where continued association could reasonably harm customers, the Program or the Xanadu Living brand.

18. Confidentiality

The Creator must not disclose non-public information received through the Program, including:

  1. Unreleased promotions.
  2. Confidential commission offers.
  3. Campaign plans and launch dates.
  4. Supplier information.
  5. Internal business information.
  6. Customer personal information.
  7. Information clearly identified as confidential.

This clause does not prevent a Creator from:

  1. Making a disclosure required by law.
  2. Reporting unlawful conduct to an appropriate authority.
  3. Obtaining confidential professional advice.

19. Privacy

Xanadu Living may collect and use Creator information for:

  1. Assessing Program applications.
  2. Administering Creator accounts.
  3. Tracking and paying commission.
  4. Communicating about the Program.
  5. Preventing fraud and misuse.
  6. Meeting legal, accounting and taxation obligations.

Creator information may be processed through Shopify Collabs, Shopify, payment providers and other service providers used to administer the Program.

The Creator must not collect, store, use or disclose Xanadu Living customer information except where expressly authorised and legally permitted.

Participation in the Program does not give the Creator access to customer names, addresses, email addresses or other personal information unless specifically authorised.

20. Suspension and termination

Either party may end the Creator’s participation by giving written notice.

Xanadu Living may immediately suspend or terminate participation where it reasonably believes that the Creator has:

  1. Engaged in fraud or artificial activity.
  2. Misused a Creator Code or Creator Link.
  3. Made false or misleading claims.
  4. Failed to disclose the commercial relationship.
  5. Misused confidential information or intellectual property.
  6. Seriously harmed or placed the Xanadu Living brand at risk.
  7. Breached applicable law or platform rules.
  8. Materially breached these terms.

On termination:

  1. The Creator must stop presenting themselves as a Xanadu Living Creator Collective member.
  2. The Creator must stop distributing their Creator Code and Creator Link.
  3. Xanadu Living may deactivate the Creator Code and Creator Link.
  4. Confidential information and supplied assets must no longer be used.
  5. Existing posts may remain online unless Xanadu Living reasonably requests their removal or correction.

Valid commission earned before termination remains payable after the applicable validation period, subject to refunds, returns, cancellations, fraud, withholding obligations and these terms.

No further commission is earned from transactions occurring after a Creator Code or Creator Link has been deactivated.

21. Program changes

Xanadu Living may update:

  1. These terms.
  2. Commission rates and tiers.
  3. Product eligibility.
  4. Creator Code conditions.
  5. Campaign rules.
  6. Payment or tracking systems.

Where a change materially affects Creators, Xanadu Living will provide reasonable notice by email, through Shopify Collabs or through the Program page.

Changes will apply prospectively unless:

  1. A change is required by law.
  2. A change is required to address fraud, security or misuse.
  3. The Creator agrees otherwise.

Commission already confirmed before a change will not be retrospectively reduced, except where a sale is later refunded, returned, cancelled, charged back or found to be ineligible.

Continued participation after the effective date of updated terms constitutes acceptance of the updated terms.

22. Email acceptance

Where acceptance is completed by email, the Creator must reply with:

β€œI AGREE to the Xanadu Living Creator Collective Program Terms dated 14 September 2026. My full legal name is [FULL NAME]. I confirm that I have read and accepted the Program Terms.”

If the Creator has an ABN, they may also provide:

β€œMy ABN is [ABN], and I am/am not registered for GST.”

Providing an ABN is not a requirement for joining the Program.

Xanadu Living may request additional taxation or payment information where reasonably required to process commission payments lawfully.

Xanadu Living will retain the Creator’s acceptance email together with the version of the terms accepted by the Creator.

An electronic acceptance or email reply has the same effect as a written signature to the extent permitted by law.

23. Disputes and enquiries

A Creator who believes that a commission payment or attribution record is incorrect should contact contact@xanaduliving.com.au and provide:

  1. Their full name.
  2. Creator Code or Creator Link.
  3. Relevant order information, if available.
  4. A description of the issue.
  5. Supporting evidence.

The parties will attempt to resolve disputes in good faith before commencing formal proceedings, except where urgent legal relief is required.

24. Liability

To the extent permitted by law, Xanadu Living does not guarantee:

  1. Website or tracking-platform availability.
  2. Accurate tracking where customers block cookies or do not use the Creator Code or Creator Link.
  3. Any particular level of traffic, sales or commission.
  4. Continued availability of any product.
  5. Future paid work, gifted products or collaboration opportunities.
  6. That participation will be profitable for the Creator.

Each party remains responsible for its own acts and omissions.

The Creator is responsible for claims, losses or reasonable costs arising directly from:

  1. Content created or published by the Creator.
  2. A false, misleading or unauthorised representation made by the Creator.
  3. Infringement of another person’s intellectual property or privacy rights by the Creator.
  4. Fraud or deliberate misuse of the Program.
  5. A material breach of these terms.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory right, liability or remedy that cannot lawfully be excluded.

25. General provisions

Entire agreement

These terms and any written campaign-specific agreement constitute the agreement between the parties concerning the Program.

Additional campaign terms

Where a specific campaign has additional written terms, those terms apply to that campaign. If there is an inconsistency, the campaign-specific terms take priority only for that campaign.

Assignment

The Creator must not transfer or assign their rights under these terms without written approval from Xanadu Living.

No waiver

A failure or delay in enforcing a right does not waive that right.

Severability

If any part of these terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary. The remaining terms will continue to operate.

Notices

Notices may be provided by email, Shopify Collabs or another electronic method normally used to administer the Program.

The Creator is responsible for keeping their contact information current.

Governing law

These terms are governed by the laws of Victoria, Australia.

The parties submit to the courts and tribunals having jurisdiction in Victoria, subject to any applicable right to bring a claim in another jurisdiction.
